Documents required for transferring DDA residential plots

Here is the list of documents required to transfer DDA residential plots. The transfer could be undertaken with/without a WILL in case of death, or through Gift Deed.

At some point in your life, you would require to transfer your property either to a family member or to someone outside blood relation. If you own a residential plot allotted by Delhi Development Authority (DDA), you will need to fill certain documents and submit these to the authority.

The documents required will depend on the situation the transfer is being done. The ownership on the leasehold rights of the property changes hands on account of sale, transfer, gift, exchange, death or by operation of any law or any other mode recognized under the Transfer of Property Act.

Mutation in case of death

After the death of the owner of a DDA plot, transferring could be taken over in two scenarios -
  1. When a WILL has not been left behind
  2. When a WILL has been left behind

In cases of death, where a WILL has NOT been left behind by the allottee/lessee/sub-lessee, one requires the following documents -
  • Affidavit
  • Indemnity Bond
  • Relinquishment Deed
  • Original Death Certificate
  • Proof of relationship - sopy of ration card, passport or voter’s ID card, duly attested by gazetted officer/notary public/magistrate
  • No Objection Certificate (NOC) or redemption deed, if plot is mortgaged
  • One photograph and three specimen signatures of mutate, duly attested by class I gazetted officer/Ist class magistrate.
  • NOC from the society (in case of a society plot)
  • Copy of “D” form/completion certificate duly attested

In cases of death, where a WILL HAS been left behind by the allottee/lessee/sub-lessee, you would require documents such as -
  • Affidavit
  • Indemnity Bond
  • In case the “Will” is unregistered, NOCs from all the class I legal heirs for mutation in favour of legatee
  • Certified copy of the “Will” left by the allottee/lessee/sub-lessee.
  • Original Death Certificate
  • Proof of relationship - copy of ration card, passport or voter’s identity card, duly attested by gazetted officer/Notary Public/Magistrate
  • Copy of “D” form/completion certificate
  • One photograph and three specimen signatures of mutatee duly attested by class I gazetted officer/Ist class magistrate.
  • NOC or redemption deed, if plot is mortgaged
  • NOC from the society (in case of a society plot)
  • Transferring outside blood relation

In case of death, a property can be transferred to a person outside blood relation, only if a WILL has been made in favor of that person/party. The important documents required are -
  • Affidavit
  • Indemnity Bond
  • Certified copy of “Will” left by allottee/lessee/subleasee
  • Original Death Certificate
  • Duly attested copy of ration card, passport or voter’s identity card
  • Copy of “D” Form/completion certificate
  • One photograph and three specimen signatures of mutatee duly attested by Class I gazetted Officer
  • NOC or redemption deed, if plot is mortgaged
  • A certified copy of assessment order of income tax and house tax receipt showing the name of the person in whose name property is being assessed
  • Proof of payment of ground rent from the society [in case of a cooperative society plot]
  • Transferring via Gift Deed

In case the property needs to be transferred during the lifetime of the owner, it can be gifted by executing a Gift Deed. The requisite documents for the same are -
  • Affidavit of Donor
  • Affidavit of Donee
  • Indemnity Bond [to be submitted by Donor]
  • Indemnity Bond [to be submitted by Donee]
  • Gift Deed [substitution of name of family member]
  • Gift Deed [inclusion of name of family member]
  • Proof of relationship of donee with the donor - copy of ration card, passport or voter’s identity cards, duly attested
  • One photograph and three specimen signatures of donee duly attested by class I gazetted officer/Ist class magistrate
  • No dues certificate from the society in case of a cooperative society
