HUDA INVITES APPLICATIONS FROM OUSTEES TO ALLOT PLOTS

CHANDIGARH: In a bid to settle all oustee claims, the Haryana urban development authority (Huda) will be inviting applications from oustees for allotment of plots by the month-end. The applications will be invited through advertisements.

J Ganesan, chief administrator, Huda, said, “We are in the process of collecting all the details regarding the plots available, and the oustee numbers in each of our estate offices. As soon as this information is ready we will issue advertisements inviting application from the oustees for allotment of plots. We expect the entire process to be completed in a month.”

Oustees are people whose lands have been acquired in lieu of allotment of plots, in addition to the compensation received under the Land Acquisition Act.

The scheme will be exclusively for the oustees.

Following the directions of Punjab and Haryana high court, Huda will allot plots in a sector to the oustees before the general applicants.

Settling several contentious issues regarding the oustees’ plot allotments, the HC had earlier directed that if there are any unallotted plots in a sector in the state, they would henceforth be first allotted to the oustees to the extent of reservation in their favour and only thereafter be allotted to the general applicants.

The HC had also stated that to get a plot under the oustees’ quota, such a person has to apply for the plot and he would not be automatically entitled for allotment of plot without any application.

In line with the HC order, Huda estate offices will invite application from the oustees. A screening committee headed by administrator, for each estate office, will examine the applications submitted.

Allotment of plots will be made as per the current price. The price will be calculated as per the Huda formula.

Allotment of plots to oustees has long been a contentious issue with many approaching courts against policies in place.

Haryana may consider restructuring infra charges on realtors

Haryana government will consider restructuring of infrastructure development charges payable by real estate developers on a case to case basis in view of slowdown in the property market.

Addressing the realtor’s apex body CREDAI’s conclave, Haryana Chief Minister Manohar Lal Khattar said the deferment of development charges called EDC/IDC for all the developers would not be “beneficial” as government also needs funds for the development of infrastructure and to run welfare schemes.

“I know that the financial conditions of all the developers are not the same,” he said while responding to the industry’s demand of restructuring the payment of EDC (External Development Charges) and IDC (Infrastructure Development Charges).

The Chief Minister asked builders with good financial health to complete the ongoing projects instead of expansion.

“We will have to find an amicable solution,” Khattar said on the sidelines of the event.

CREDAI President Getamber Anand demanded that the Haryana government should restructure the EDC/IDC amount payable by the builders with penalties, similar to the lines of the Uttar Pradesh Government. He said the developers are not able to pay EDC/IDC charges due to slowdown in the real estate market, particularly housing segment.

The Haryana CM said also assured that industry that he would look into their concerns while establishing the real estate regulator in the state.

According to the Real Estate (Regulation and Development) Bill, 2015, which was approved by the Cabinet last week, the states and UTs need to establish the ‘Real Estate Regulatory Authority’ to regulate real estate transactions.

The industry is demanding that the proposed law should not be applicable on ongoing projects. It wants the government authorities, which give various approvals for the project development, to be brought under the ambit of this bill.

Khattar asked the builders and financial institutions to focus on the development of affordable homes in a planned way. He said the government has framed a New Integrated Licensing Policy for overall development of the state.

Seeking investment in the state, the Chief Minister said that the connectivity and infrastructure facilities are being improved. He informed that the two smart cities have been included in the list of 100 smart cities to be developed across the country.

Khattar said his government plans to develop Gurgaon as ‘Smart City’, although it has not been included in the list.

The state government could infuse its own funds for developing Gurgaon as smart city, he added.

Khattar informed that Haryana would organise a global investors meet during March 7-9, 2016, to attract investments in the state.

HUDA makes rules to check building site pollution

Huda on January 3 issued an advisory to check pollution caused by construction sites.

The advisory has directed builders and individual contractors to follow all construction norms, such as covering trucks and vehicles that carry construction material, and has also asked them not to burn any kind of waste, including plastic material or tree leaves in open areas.

The advisory, issued by the newly appointed Huda administrator Hardeep Singh, stated that every builder or house owner is advised to put tarpaulin around the area of construction, so that dust emissions from the construction site are controlled. "Construction material of any kind that is stored in the site should also be fully covered. Construction material, particularly sand, cannot be stored on any part of the street," stated the advisory.

Last year, Haryana State Pollution Control Board (HSPCB) inspected 33 construction sites across the city, and served notices to 27 developers who were found violating norms, of which 22 had to pay penalties ranging from Rs 50,000 to Rs 3 lakh per violation.

The Ministry of Environment and Forest (MoEF), 2010 guidelines on construction methods make it mandatory for construction companies to cover the construction site with a boundary sheet/wall, construction material shouldn't be left in open, vehicles carrying construction material should be fully covered and install sprinklers to control air pollution caused by construction activities.
